These Terms & Conditions (“Terms”) govern your use of Sommar, which is operated as a sole proprietorship. By using Sommar, you agree to these Terms. If you do not agree, do not use the service.
The service
Sommar provides UV information, sunscreen reminders, estimated protection periods, inventory tools, protection history, widgets, Live Activities, and related product features.
Sommar is a planning and reminder tool. It is not medical advice, a medical device, or a substitute for sunscreen, clothing, shade, or professional advice. UV readings and protection durations are estimates. They may be affected by weather changes, water, sweat, activity, application quality, product differences, location accuracy, and delayed data.
Eligibility
You must be legally able to enter into these Terms in your jurisdiction. If you use Sommar on behalf of another person, you are responsible for obtaining appropriate permission.
Subscriptions and purchases
Some Sommar features may require a subscription or purchase.
Payments are processed by Apple through the App Store. Subscriptions may automatically renew unless cancelled through your Apple account settings before the renewal period ends. Refunds, cancellations, and billing disputes are handled according to Apple’s applicable terms and policies. Sommar does not receive or store your full payment-card number.
Acceptable use
You agree not to:
- Use Sommar unlawfully or abusively.
- Attempt to interfere with or compromise the service.
- Reverse engineer, copy, resell, or redistribute the service except as permitted by law.
- Misrepresent information used to calculate protection or inventory.
- Use Sommar as a substitute for medical, dermatological, emergency, or professional advice.
Your content
You retain ownership of information you enter into Sommar. You grant Sommar only the limited rights necessary to store, process, display, and provide the requested features. You are responsible for the accuracy of information you provide.
Intellectual property
Sommar, including its software, design, branding, text, illustrations, animations, calculations, and arrangement, is owned by or licensed to the operator of Sommar and protected by applicable law. These Terms do not transfer ownership to you. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Sommar for its intended purpose.
Third-party services
Sommar may rely on Apple, WeatherKit, RevenueCat, the App Store, notification, location, and other third-party services. Their availability and terms are outside our control.
Availability and changes
We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted, error-free, or permanently available service.
Disclaimer
To the maximum extent permitted by law, Sommar is provided “as is” and “as available.” We disclaim warranties not expressly stated in these Terms, including warranties of accuracy, fitness for a particular purpose, merchantability, availability, and non-infringement. Do not rely on Sommar as your sole method of sun protection or safety planning.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, business, or opportunity arising from your use of Sommar. Where liability cannot be excluded, it will be limited to the amount you paid to Sommar for the applicable service during the 12 months before the event giving rise to the claim, subject to mandatory law.
Indemnity
To the extent permitted by law, you agree to defend and hold harmless Sommar and the sole proprietorship that operates it from claims, losses, liabilities, and expenses arising from your unlawful use of Sommar, violation of these Terms, or misuse of information provided by the service.
Termination
You may stop using Sommar at any time. We may suspend or terminate access if you violate these Terms, create security or legal risk, or misuse the service. Provisions concerning ownership, disclaimers, liability, indemnity, disputes, and any obligations that should reasonably survive termination will survive.
Changes
We may update these Terms by posting a revised version with a new effective date. Continued use after the effective date means you accept the revised Terms.
